Trump plans to rescind work permits for spouses of immigrants on H-1B visas

  1. What are H-4 EADs?

 

EAD stands for Employment Authorization Document and is card that provide evidence that a non-immigrant is authorized to work on the U.S.  EADs are commonly issued for students performing their OPT – Occupation Practical Training and applicants who have applied for and are waiting their green card. Historically, H-4 visa holders, spouses and children of H-1B holders, were not authorized to work in the U.S.  In 2015 the Obama administration implemented a rule that would allow H-4 spouses to obtain an EAD and work in the U.S.

 

  1. Why does it matter if this immigration benefit is rescinded?

 

The U.S. is already seeing a worker shortage in various sectors.  In July 2018 the unemployment rate declined to 3.9%. According to a recent June survey, of the US employers surveyed, 46%, said they can't find the skills they need.  We cannot hire American if there is no one left to hire.  U.S. employers need immigrants to file the worker shortages.

 

Additionally, spouses, which are mainly women, are negatively impacted.  Because of the backlog, the waiting period to obtain a green card can 10 years or more.  Women who want work cannot work and contribute to the growth of the U.S. economy.
